In pre-1994 South Africa the discourse on sexuality was rigidly controlled by apartheid and a distinct bias in favour of a certain brand of Christianity.
    Two questions arise from the recognition of same-sex unions by way of the Civil Union Act. The first question relates to the scope of the legal consequences and protection provided to same-sex couples by the Civil Union Act.
    The study includes constitutional arguments pertaining to the continued recognition of same-sex life partnerships and a critical analysis of the constitutionality of the Civil Union Act as a separate measure to govern same-sex marriage. This investigation is conducted with reference to relevant legislation and case law.
